Terms of Use for PhotoClean AI

These Terms of Use govern your access to and use of the PhotoClean AI mobile application on Android and iOS.

PhotoClean AI is published on Google Play under the developer name HPITStudioDev and on the Apple App Store under the developer name Hai Vo.

By downloading, installing, purchasing, or using PhotoClean AI, you agree to these Terms. If you do not agree, do not use the application.

1. Application Purpose

PhotoClean AI is a local photo management and cleanup application.

Its main features may include:

  • Duplicate photo detection

  • Similar photo detection

  • Screenshot detection

  • Large or blurry photo detection

  • Photo cleanup and organization

  • Private photo or vault management

  • Image blurring

  • Collage creation

  • Signature tools

  • Image editing and exporting

  • Storage optimization

Features may vary depending on the application version, device, operating system, and platform.

2. License to Use the Application

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use PhotoClean AI on devices that you own or control, subject to these Terms and the rules of the applicable app store.

This license is provided only for personal and lawful use.

No ownership rights in PhotoClean AI are transferred to you.

3. Local Processing and User Data

PhotoClean AI primarily scans, analyzes, organizes, edits, and manages photos locally on your device.

We do not provide an online account for storing your photo library.

We do not operate a server database that stores or manages your photos, locally generated image hashes, scan results, duplicate groups, or similar-photo groups.

We cannot remotely access, recover, manage, or delete information that exists only on your device.

Limited technical information may still be processed by app store, advertising, analytics, crash-reporting, or subscription services used by the application, as explained in the PhotoClean AI Privacy Policy.

4. Permissions and User Content

PhotoClean AI may request access to photos, media, storage, camera, notifications, or an internet connection depending on the features you use.

You retain ownership of the photos, images, files, and other content that you access or process through the application.

PhotoClean AI does not claim ownership of your content.

You are responsible for ensuring that:

  • You own or have permission to use the content.

  • Your use of the content complies with applicable laws.

  • Your actions do not violate another person’s privacy, copyright, or other rights.

  • You review selected content before deleting, editing, moving, hiding, or exporting it.

You may manage or revoke application permissions through your device settings.

5. Photo Deletion and File Management

PhotoClean AI may allow you to select and delete photos directly through the application.

Deletion occurs only after an action initiated or confirmed by you, subject to the permission and confirmation requirements of Android or iOS.

Deleted photos may be moved to the device’s Trash, Recycle Bin, or Recently Deleted folder and may remain recoverable for a period controlled by the operating system.

You are responsible for reviewing selected items before confirming deletion.

We are not responsible for:

  • Accidental deletion

  • Selection of the wrong photo

  • Loss of locally stored files

  • Failure to recover deleted content

  • Loss caused by clearing application data

  • Loss caused by uninstalling the application

  • Device failure, reset, damage, or loss

  • Operating-system or storage errors

You should keep separate backups of important photos.

6. Private Photo and Vault Features

If PhotoClean AI provides a vault or private-photo feature, selected content is stored locally in an application-controlled area of your device.

Private content may be protected by a password, PIN, device authentication, local encryption, or other available security features.

We do not keep a remote copy of your vault content and cannot restore it for you.

Clearing application data, uninstalling PhotoClean AI, resetting your device, forgetting your access credentials, or losing the device may permanently remove or make private content inaccessible.

You are responsible for maintaining appropriate backups and protecting access to your device.

7. Accuracy of Scan Results

PhotoClean AI uses automated methods to detect duplicate, similar, blurry, large, or unwanted photos.

Automated results and storage estimates may not always be complete or accurate.

Photos that appear similar may still contain meaningful differences. Important photos may be included in a suggested cleanup group.

You must review all suggested results before deleting or modifying any content.

PhotoClean AI does not guarantee that every duplicate, similar, blurry, screenshot, or large file will be detected correctly.

8. Premium Features and Purchases

PhotoClean AI may provide free features, paid features, subscriptions, free trials, introductory offers, or one-time purchases.

The price, billing period, included features, trial conditions, and renewal terms applicable to a purchase are displayed on the purchase screen before confirmation.

Payments are processed through:

  • Google Play for Android purchases

  • Apple App Store for iOS purchases

We do not directly collect or store your complete payment-card information.

Purchases and subscriptions are subject to the billing, cancellation, and refund rules of the platform where the purchase was made.

9. Auto-Renewable Subscriptions

When you purchase an auto-renewable subscription:

  • Payment is charged to your Google Play or Apple account after purchase confirmation.

  • The subscription renews automatically unless canceled through your app-store account before the current billing period ends.

  • Your app-store account may be charged for renewal according to the price and billing period shown when you subscribed.

  • Any free trial converts to a paid subscription unless canceled before the trial ends.

  • Deleting PhotoClean AI does not cancel an active subscription.

You can manage or cancel your subscription through your Google Play or Apple account subscription settings.

Refund requests must be submitted through the platform that processed the purchase, subject to that platform’s applicable policies.

10. Advertising and Third-Party Services

PhotoClean AI may use third-party services for:

  • Advertising

  • Analytics

  • Crash reporting

  • Purchase processing

  • Subscription validation

  • App-store functionality

  • Performance monitoring

Third-party services operate under their own terms and privacy policies.

We do not control every feature, policy, availability, or data-processing practice of third-party providers.

Use of third-party services may require an internet connection and may be subject to additional terms.

11. Acceptable Use

You agree not to:

  • Use PhotoClean AI for unlawful, harmful, fraudulent, or abusive purposes.

  • Use the application to violate another person’s privacy or intellectual-property rights.

  • Attempt to gain unauthorized access to the application or related services.

  • Interfere with application security or normal operation.

  • Introduce malicious code, automated attacks, or harmful content.

  • Reverse engineer, decompile, disassemble, or modify the application except where applicable law expressly permits it.

  • Copy, rent, lease, sell, sublicense, redistribute, or commercially exploit PhotoClean AI without written permission.

  • Bypass premium access, purchase validation, usage restrictions, or security protections.

  • Misrepresent your ownership of content processed through the application.

12. Intellectual Property

PhotoClean AI, including its source code, design, branding, icons, interface, text, graphics, software, and original application materials, is owned by the applicable developer, publisher, or its licensors.

These Terms do not grant you permission to use our names, trademarks, logos, designs, or other protected materials outside normal use of the application.

Third-party names, software, and materials remain the property of their respective owners.

13. Application Availability and Updates

We may add, change, limit, suspend, or discontinue application features when reasonably necessary for maintenance, security, platform compliance, technical limitations, or product development.

Updates may be required for continued use of certain features.

We do not guarantee that PhotoClean AI will:

  • Always be available

  • Operate without interruption

  • Be completely free from errors

  • Support every device or operating-system version

  • Support every image format

  • Produce perfectly accurate scan results

  • Remain compatible with modified or unsupported devices

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, PhotoClean AI is provided on an “as is” and “as available” basis.

We make no warranties regarding uninterrupted operation, accuracy, availability, compatibility, security, fitness for a particular purpose, or recovery of deleted or lost files.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the applicable developer or publisher will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of PhotoClean AI.

This includes loss resulting from:

  • Deleted or modified photos

  • Lost application or vault data

  • Device or storage failure

  • Inaccurate scan suggestions

  • Inability to restore files

  • Application interruption

  • Third-party services

  • Subscription or app-store issues

  • Unauthorized access to your device

Our total liability will not exceed the amount you paid for PhotoClean AI during the twelve months before the event giving rise to the claim, unless applicable law requires otherwise.

These limitations do not apply where liability cannot legally be limited or excluded.

16. Suspension and Termination

You may stop using PhotoClean AI at any time by uninstalling it and canceling any active subscription separately through the applicable app store.

We may limit or terminate access to certain services if you:

  • Materially violate these Terms

  • Misuse the application

  • Attempt to bypass security or payment systems

  • Create legal, security, or technical risks

  • Engage in fraudulent or unlawful activity

Termination does not automatically cancel an app-store subscription.

17. Apple App Store Terms

For the iOS version of PhotoClean AI:

  • These Terms are between you and the applicable developer, not Apple.

  • The applicable developer, not Apple, is responsible for PhotoClean AI and its content.

  • Apple has no obligation to provide maintenance or support for PhotoClean AI.

  • Apple is not responsible for claims relating to the application, including product-liability, legal-compliance, consumer-protection, or intellectual-property claims.

  • Your use of PhotoClean AI must comply with Apple’s applicable usage rules and third-party agreements.

  • You confirm that you are not located in a country subject to applicable United States government restrictions and are not listed on a prohibited or restricted-party list.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you after your acceptance.

Any rights that cannot be excluded under applicable law remain unaffected.

18. Google Play Terms

For the Android version of PhotoClean AI:

  • These Terms are between you and the applicable developer or publisher, not Google.

  • Google is not responsible for providing support, maintenance, warranties, or resolving claims relating to PhotoClean AI.

  • Your use of the application must comply with Google Play’s applicable terms and policies.

  • Purchases made through Google Play are also subject to Google Play’s billing, cancellation, and refund rules.

19. Changes to These Terms

We may update these Terms to reflect changes to:

  • Application features

  • Purchases or subscriptions

  • Platform requirements

  • Third-party services

  • Security practices

  • Applicable laws

When these Terms are updated, the Effective Date at the top of this page will be revised.

Material changes may also be communicated through the application or store listing where appropriate.

Continued use of PhotoClean AI after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
